Using Your Discount Card
The Subscription Card proves your eligibility to claim discounts/benefits made available by participating third-party retailers (participating retailers).
To use it, you must sign your Subscription Card.
The Subscription Card will remain valid for the period dated on the card.
Upon presenting your valid Subscription Card, participating retailers will apply the offer/benefit to your purchase (as advertised).
You must inform participating retailers that you have a Subscription Card before the point of purchase.
All subscribers must provide their card when claiming a benefit. World of Nishikigoi Ltd is not responsible for proving a subscriber's eligibility to any of our participating retailers.
The card holder must ensure the appropriate discounts/benefits are applied before authorising the transaction. If a card holder continues with their purchase (without the discount/benefit) it will be down to the participating retailer's discretion whether they provide a refund on the discount/benefit amount.
Your Subscription Card is non-transferable and cannot be used by any third party. It is for the sole use of the card holder only. At their discretion, participating retailers may ask you to show photo identification to confirm that you are a Subscription Card holder. Any misuse or attempted misuse of the Subscription Card will result in the card holder forfeiting their benefit rights.
Participating retailers reserve the right to refuse the Subscription Card and the application of any offer/benefit to some or all of their goods and/or services at their sole discretion. World of Nishikigoi Ltd is not responsible for any such refusal.
Participating Retailers reserve the right to add, amend or withdraw their offers/benefits at any time. World of Nishikigoi Ltd is not responsible for any such withdrawals or changes.
Participating retailers are responsible for any transaction through their external sites/premises. Their terms and conditions will apply.

World of Nishikigoi Ltd cannot be held responsible by any party for any use/misuse of a Subscription Card.
World of Nishikigoi Ltd cannot be held responsible by any party for the interaction between a card holder and a participating retailer and whatever outcome such an interaction may result in.
World of Nishikigoi Ltd is not responsible or liable for any consequential errors or omissions within the Subscription Card service or its terms and conditions.
Loss, Theft or Damage
Subscription Cards get posted to the address that the subscriber provides upon payment. They get sent with the subscriber's magazine. Once this card has left the World of Nishikigoi Ltd premises, we are not responsible for any loss or non-arrival of the card.
Subscription cards are not valid for any refund or return.
Subscribers are solely responsible for the safekeeping of their card. If a card is lost or stolen, World of Nishikigoi Ltd is under no obligation to replace the card.
For Retailers
All participating retailers are requested to advise World of Nishikigoi Ltd of any additions, amendments, withdrawals or any changes whatsoever to any discounts/benefits they wish to advertise on the World of Nishikigoi website.
World of Nishikigoi requests two weeks' notice to update our website for any new offers or changes to existing offers/benefits/discounts.
A discount/benefit may be withdrawn at any time by giving 48 hours notice. Please contact liam@worldofnishikigoi.com
Retailers may cancel their participation in the Subscription Card Scheme at any time by giving two weeks' notice. Cancellation of participation in the scheme does not entitle retailers to any refund of any kind.
Card renewal.
The Subscription Card comes as a package with a subscription to the World of Nishikigoi magazine. The subscription to the magazine lasts 12 months, as does the validity of the Subscription Card. After 12 months, your subscription will get automatically renewed - via the direct debit details you supplied. The appropriate fees shall be taken, and your subscription shall be renewed for a further 12 months. Your new Subscription Card will get delivered with the first magazine of your new subscription. World of Nishikigoi Ltd cannot be held responsible or liable for any delay in the new card arriving.
You can cancel your magazine subscription renewal at any time.
World of Nishikigoi Ltd reserves the right not to refund any monies paid for magazines yet to be received as part of the subscription.
If your subscription to the magazine gets terminated, your Subscription Card will remain valid for the length of time dated on the card.
Complaints Procedure

Complaints about specific offers/discounts/benefits should get directed to the participating retailer responsible.
Termination
World of Nishikigoi Ltd reserves the right, at any time and without notice, to:
amend or waive any provision of these Terms from time to time; and/or
terminate the Subscription Card Scheme; and/or
decline to issue Subscription Cards; and/or
decline to accept an application from a Retailer to join the scheme: and/or
on reasonable grounds, withdraw or cancel Subscription Cards or participating retailers, where reasonable grounds shall include (but not be limited to):
any abuse or attempted abuse of the scheme; and/or
any use or attempted use of a Subscription Card in a manner which is contrary to these Terms; and/or
any reasonable suspicion of dishonesty World of Nishikigoi Ltd may have on your part in connection with the Subscription Card Scheme.
Our Liability
World of Nishikigoi Ltd will not be responsible for any indirect losses, consequential, exemplary, special or punitive damages, lost opportunities, loss of profits, anticipated profits, or actual or anticipated savings.
World of Nishikigoi Ltd does not limit its liability at law for fraudulent misrepresentation or for death or personal injury caused by negligence or any other type of liability which cannot (by law) be excluded or limited.
Where you make a purchase using your Subscription Card from any participating retailer, any losses or liability arising out of or in connection with such purchases shall be the relevant participating retailer’s liability. World of Nishikigoi Ltd does not accept liability for unsatisfactory experiences or any failure by the participating retailers to deliver expected goods or services or the quality thereof.
World of Nishikigoi Ltd will not be under any obligation to become involved in any dispute between you and any participating retailer. Any complaints should be taken up with the participating retailer.
World of Nishikigoi Ltd does not give any warranty for any goods or services purchased with the use of the Subscription Card.
This indemnification will survive the termination of this Contract.
Events Outside of Our Control (Force Majeure)
World of Nishikigoi Ltd shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control. These include, but are not limited to, acts of God, power failure, internet service provider failure, industrial action, war, fire, explosion, acts of terrorism, governmental action, epidemic, pandemic or another natural disaster, or any other event that is beyond its control, and World of Nishikigoi Ltd shall be entitled to a reasonable extension of its obligations. If the delay persists for such time as World of Nishikigoi Ltd considers unreasonable, it may, without liability on its part, terminate this agreement.
Other Important Terms
World of Nishikigoi Ltd reserves the right to amend these terms and conditions at any time by publishing a notice on its website to that effect.
These terms and conditions constitute the whole agreement between World of Nishikigoi Ltd, Retailers and You and supersede all previous discussion, correspondence, negotiations, previous arrangements, understanding or agreement between us relating to the subject matter of these terms and conditions.
Each of the parties agrees that it has not entered into these terms and conditions in reliance on and shall have no remedy in respect of any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these terms and conditions or not) other than as expressly set out in these terms and conditions.
If any part of this contract is found to be void or unenforceable by any Court of competent jurisdiction, such part shall be severed from this contract, which will otherwise remain in full force and effect.
The failure by World of Nishikigoi Ltd at any time or for any period to enforce any one or more of these Terms and Conditions shall not be a waiver of them or a waiver of the right to enforce such Terms and Conditions on a future occasion.
You may not assign this contract or any rights or obligations under it without our prior written consent.
A person who is not a party to the Contract shall have no rights under the Contract pursuant to the Contracts (Rights of Third Parties) Act 1999.
Governing Law and Jurisdiction
This Contract shall be governed by and construed in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
